What Is MPCB Consent To Operate (CTO)?
Consent to Operate is the permission from the Maharashtra Pollution Control Board (MPCB) to start production, including trial production. It is issued under the Water Act, 1974 and the Air Act, 1981, and usually carries the hazardous waste authorisation under the Hazardous and Other Wastes Rules, 2016 in the same letter.
By the time you apply, your building and machinery are ready. MPCB now wants to see that your ETP or STP, stack and waste storage are installed and working. The consent letter lists what you may produce, the discharge and emission limits, your monitoring and reporting duties and the date the consent ends.

Step-By-Step Process To Get Consent To Operate
- Confirm your category and whether you need a first CTO, a renewal or an amendment.
- Check plant readiness. The ETP or STP, stack and waste storage must be installed and running before you apply.
- Collect documents and lab reports for treated water, stack emissions and noise.
- File the online application on the MPCB portal and pay the consent fee. New industries also register on the state's Maitri single-window platform.
- Reply to MPCB queries quickly and precisely.
- Site inspection by an officer of the Pune regional or sub-regional office, who compares what you declared with what is on site.
- Decision and consent letter. Larger and Red category cases go to MPCB's consent committee. Read the conditions carefully and note the renewal date.
How Long Does MPCB Take?
| Category | Consent To Establish | Consent To Operate | Renewal |
|---|---|---|---|
| Green | Up to 30 days | Up to 30 days | Up to 30 days |
| Orange | Up to 45 days | Up to 60 days | Up to 60 days |
| Red | Up to 60 days | Up to 90 days | Up to 120 days |
These limits apply once the application is complete. Missing papers and unanswered queries are what stretch the process, so apply at least 90 days before you plan to begin trial production.
Consent To Operate Renewal: Start 60 Days Early
MPCB consent letters ask for renewal applications at least 60 days before expiry. Treat that as the last date, not the target. MPCB checks your compliance history before renewing, so keep these ready:
- Fresh effluent, stack and noise test reports
- Compliance report against every condition of the previous consent
- Form 5 and Form 4 returns for the past year
- Details of any added machinery, products or production capacity
Why MPCB Consent To Operate Applications Get Delayed Or Rejected
- ETP or STP capacity lower than the effluent quantity shown in the application
- Water balance that does not add up
- Wrong category or vague description of the activity
- Old, incomplete or non-accredited lab reports
- Pending returns or fees from earlier consents
- Expansion or new machinery without the matching consent
Penalty For Running Without Valid MPCB Consent
The Water Act and the Air Act both prohibit operating a plant without the State Board's consent. A unit without valid consent can face a show-cause notice, penalty, directions to stop operations and disconnection of power or water supply. Banks, customers and auditors also ask for a current consent, so letting it lapse costs far more than renewing on time.
